At the state level there are no institutions of lawyer’s profession in Bosnia and Herzegovina. Bar Associations in Bosnia and Herzegovina are organized at the entity level. According to the Law on Lawyer’s Profession of the Federation of BiH, lawyer’s profession is an independent professional activity, which is organized and operates in accordance with the laws and regulations adopted pursuant to law.
The bodies of the Federal Bar Association are: General Assembly, Board, President and Vice President, the supervisory board, the disciplinary court and disciplinary prosecutor, commission for bar exams and other bodies established by the Statute of the Federal Bar Association.
The term of the bodies of the Federal Bar Association is four years.
Lawyer’s profession in Bosnia and Herzegovina includes: provision of legal advice, drafting various submissions (claims, complaints, requests, petitions, applications, etc.); drafting of various documents, representation of clients in all civil, administrative and other procedures before all regular and other courts, government bodies, arbitration and legal persons; defense and representation of the defendant in criminal, civil and other proceedings; provision of other forms of legal assistance.
Lawyer’s profession as a professional activity is conducted by lawyers as individuals. Lawyers for the purpose of joint exercise of the profession may form a joint law office and law associations.
The lawyer has a duty to keep as a professional secret everything entrusted to him, unless the lawyer is exempt from this obligation by express or tacit authorization of the party.
Tariff for fees and reimbursement of expenses for lawyer’s work determines remuneration and expenses incurred by lawyer’s practice.
History
The first legislative act that legalized lawyer’s profession in Bosnia and Herzegovina and regulated it normatively was "Law order for Bosnia and Herzegovina" from 1883. According to this legislative act, which was a reflection of the concept of a centralized government to control the entire life in Bosnia and Herzegovina, one of the provinces of the Austro-Hungarian monarchy, the lawyer’s profession could be performed only by "the lawyers appointed by the authorities", while disciplinary procedure was under the competence of the so-called "Karnost commissions" which were formed by administration and court, and which adjudicated by judgment on the responsibilities of lawyers and the type and length of the punishment.
Events from 1992 were reflected in the lawyer’s profession in Bosnia and Herzegovina by establishing two entity Bar Associations, the Bar Association of the Republic of Srpska and the Bar Association and the Federation of Bosnia and Herzegovina. Namely, the lawyers who had the seat of the law office on the territory of one entity constituted the bar association of the entity.
The Bar Association of the Federation of Bosnia and Herzegovina is a member of the Council of the Bar Associations and Law Societies of Europe (Council of the Bars and Law Sociétés of the European Union - CCBE).
The headquarters of the Federal Bar Association is in Sarajevo, Bosnia and Herzegovina.
